The Herd Music, LLC ("Herd," "we," "us") operates the Herd TV channel on Roku and other streaming platforms, the Herd mobile app, and related websites (together, the "Services"). This policy explains what we collect, how we use it, and the choices you have.

1. Information we collect

From your streaming device (Roku/TV): device type and model, Roku advertising identifier (RIDA) where permitted, IP address, general location (city/region derived from IP), app version, channel usage (songs and videos played, time watched), and ad delivery and engagement data.

When you scan a QR code or use the Herd app: name, email address or phone number, location (as provided at sign-up or permitted by your device), votes, hearts, comments, content you upload, and responses to interactive ad questions.

For rewards and payouts: if you win a cash reward, we or our payment and rewards partners collect the information needed to verify eligibility and send payment, which may include legal name, contact details, and payout account details. We do not store full payment account numbers ourselves.

From businesses that run Herd TV: business name, contact person, address, and venue details.

We do not knowingly collect personal information from children under 13. The Services are not directed to children, and accounts for users under 13 are not permitted.

2. How we use information

• Deliver and improve the Services, including music playback, charts, and voting.
• Serve, measure, and verify advertising, including interactive "watch and win" ad experiences.
• Determine eligibility for and deliver rewards; prevent fraud, duplicate entries, and abuse.
• Communicate with you about your account, rewards, and updates.
• Analyze usage and performance.
• Comply with law and enforce our Terms of Use.

3. How we share information

We do not sell your personal information for money. We share information with:

• Service providers who host, stream, analyze, or support the Services (for example, video hosting and analytics providers).
• Advertising and interactive ad partners, including React TV / RXP technology, to deliver ads, measure engagement, and administer rewards.
• Platform providers such as Roku, subject to their own privacy policies.
• Legal and safety recipients when required by law or to protect rights and safety.
• Business transfers in connection with a merger, acquisition, or sale of assets.

Sharing identifiers with advertising partners for targeted advertising may be considered a "sale" or "sharing" under some state laws. You can opt out as described below.

4. Your choices

• Ad tracking on Roku: go to Settings > Privacy > Advertising on your Roku device to limit ad tracking or reset your advertising identifier. We honor this setting.
• Account data: you can update or delete your Herd app account in the app or by contacting us.
• Marketing: unsubscribe using the link in any email or reply STOP to texts.
• State privacy rights: depending on where you live (including California, Colorado, Virginia, and other states), you may have rights to access, correct, delete, or obtain a copy of your data, and to opt out of targeted advertising or sale. Contact us to make a request. We will not discriminate against you for exercising these rights.

5. Data retention and security

We keep information as long as needed to provide the Services, run rewards programs, meet legal and tax obligations, and resolve disputes, then delete or de-identify it. We use reasonable administrative, technical, and physical safeguards, but no system is completely secure.

6. International users

The Services are operated in the United States. If you use them from elsewhere, your information will be processed in the U.S.

7. Changes

We may update this policy. We will post the new version here with a new effective date, and notify you of material changes where required.
