These Terms of Use ("Terms") govern your use of the Herd TV channel on Roku and other platforms, the Herd mobile app, and related websites (the "Services"), operated by The Herd Music, LLC ("Herd," "we," "us"). By using the Services, you agree to these Terms and our Privacy Policy.
You must be at least 13 to use the Services and at least 18 (or the age of majority where you live) to create a rewards account or receive cash rewards. If you use the Services on behalf of a business, you confirm you have authority to bind that business.
Herd provides music videos, audio streams, charts, voting, and interactive advertising experiences. The Services are free to viewers and participating venues and are supported by advertising. We may change, suspend, or discontinue any part of the Services at any time.
You are responsible for your account and for keeping your login secure. Provide accurate information. One account per person.
Votes and hearts are for entertainment and charting; we may remove votes we believe are fraudulent or automated. If you upload or submit content (videos, music, comments), you confirm you own it or have all necessary rights, including music and performance rights, and you grant Herd a worldwide, non-exclusive, royalty-free license to host, stream, display, promote, and distribute it in connection with the Services. You keep ownership of your content.
Do not: infringe anyone's rights; upload unlawful, hateful, sexually explicit, or harassing content; manipulate votes or rewards; use bots or scrapers; reverse engineer the Services; or interfere with their operation.
Businesses that display Herd TV publicly are responsible for complying with applicable laws for their premises. Herd provides the channel content; venues may not alter, re-record, or rebroadcast it outside the Services.
The Services, Herd name, logos, and design are owned by Herd or its licensors. Music and videos are owned by their respective artists and rights holders. We respond to copyright notices; send them to the contact below with the information required by the DMCA.
The Services run on platforms (such as Roku, Apple, and Google) and include third-party content and ads. We are not responsible for third-party services, which have their own terms.
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, TO THE FULLEST EXTENT PERMITTED BY LAW.
TO THE FULLEST EXTENT PERMITTED BY LAW, HERD WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, AND OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID US IN THE PRIOR 12 MONTHS.
We may suspend or terminate access for violations of these Terms. You may stop using the Services at any time.
These Terms are governed by the laws of the State of Tennessee, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Wilson County, Tennessee.
We may update these Terms. Continued use after changes take effect means you accept them.
